Introduction
Termite Shield ("Termite Shield") reserves the right to change this Privacy Policy from time to time at its sole discretion and without sending notice to you, so you should review this Privacy Policy periodically. The effective date of this notice and any revised or changed notice may be found on this page, on the bottom left corner of the notice. Any changes will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.
If you are an individual user and your employer purchased the online service to which this Privacy Policy applies, all of the information described in this Privacy Policy is subject to your employer's policies regarding deletion, encryption, export, monitoring, passwords, and retention of data associated with the service.
Information We Collect
Termite Shield's policy is to protect the confidentiality of the individually identifiable information that you provide, and we limit access to that information only to those with a need to know. When you visit this site, Termite Shield collects only electronic information from you (such as IP address and cookie information). If you choose to download the app and/or complete certain forms or send us requests, you will be asked to provide the following information: full name, street address, city, state ZIP, phone number, e-mail address, your home's value and its geolocation. Because payment is through Stripe, Termite Shield will not see your credit card number or banking information. We collect this information in order to provide the app and the purchased inspection services described in our agreement. We share this information with our affiliates and service providers. You may also elect to share information with the cookie providers.
Computer Information
Termite Shield logs your current Internet address (this is usually a temporary address assigned by your Internet service provider when you log in), the type of operating system you are using, and the type of browser software used. In addition, Termite Shield may keep track of what portions of this Site you are visiting. Termite Shield aggregates this information to help Termite Shield improve or create a better experience for users of the Site. For example: Termite Shield may upgrade those parts of the Site that are heavily visited.
Website Usage Information
Our website automatically records website usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the site. We do not use this information to track or record information about individuals. We will disclose this information to third parties only in aggregate form or as may be required by law. For each page that you visit, we collect and store the following technical information in what is called a web server log file:

- URL address of the Termite Shield webpage visited
- Internet domain and IP address from which our website was accessed
- Type of browser and operating system used to access our site (if provided by the browser)
- URL address of the referring page (if provided by the browser)
- Completion or success status of the request for a web page or other on-line item

The Site uses third-party analytics tools (e.g., Google Analytics, provided by Google Inc.) to collect and process data (including Personal Information) about your use of the Site, including when you visit the Site, URLs of the websites that you visit prior to visiting the Site and when you visit those websites, and IP addresses assigned to the devices from where you access the Internet.

To provide and improve the Services
Termite Shield uses your personal information – such as your address and transaction details – to respond to your inquiries and provide you with requested information; to fulfill, validate, manage, deliver, and/or track your orders and transactions; process payments; to process and verify returns and refunds; and to provide and improve our customer service.

For example, Termite Shield may use your personal information – such as your email address, telephone number, usernames, and other contact information – to respond to your inquiries; to provide you with information about your purchases, transactions, and Services; to conduct surveys, and promotions; to engage with you over Site features; to provide you offers by email, mail, and across other websites, mobile applications, social media, and online services as appropriate.

Information We Share
Termite Shield's policy is to prohibit the unlawful disclosure of your personal information. Termite Shield will not release your name or otherwise publicize the fact that you purchased goods or other information to us unless: (a) you grant Termite Shield permission to do so; or (b) Termite Shield is requested or required to do so by law.
Sale of Information
Termite Shield has not sold personal information to third parties for a business or commercial purpose in the preceding 12 months, but has disclosed information to our affiliates and service providers. Termite Shield does not sell the personal information of minors under 16 years of age without affirmative authorization.
Disclosure of Information
Termite Shield may disclose personally identifiable information you provide to third parties if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:
- Complete the sales transaction, such as providing your shipping information to our carrier
- Comply with legal process
- Enforce the Agreement
- Respond to claims that any information you provide violates the rights of third parties
- Protect the rights, property, or personal safety of Termite Shield, its users and/or the public

Service Providers
Termite Shield shares your personal information with service providers used to provide business, professional, or technical support functions for Termite Shield. Termite Shield's service providers are authorized to use your personal information only as instructed by us and for the business services they are providing to Termite Shield.
Tracking & Global Privacy Control

Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different web sites when you visit this Site.
Please note that not all tracking will stop even if you delete cookies.
Encryption
- All data transmitted between your device and the Termite Shield Platform is encrypted using HTTPS (TLS 1.2 or higher).
- Data stored in our cloud infrastructure — including databases, files, and backups — is encrypted at rest using AES-256-bit encryption with managed encryption keys.
- Access to production data is restricted to authorized personnel under least-privilege principles and protected by multi-factor authentication.
While no system can guarantee absolute security, Termite Shield follows many industry best practices to help protect your data from unauthorized access or disclosure.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL TERMITE SHIELD BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE FROM A CLAIM OF BREACH OF THIS PRIVACY POLICY. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law, or $5, whichever is less.

Retention
Termite Shield retains data in accordance with its record retention program. The criteria used to determine retention periods include: (i) the length of time we have an ongoing relationship with you; (ii) whether there is a legal obligation to which we are subject; or (iii) whether retention is advisable in light of our legal position.

You have the right to request that Termite Shield disclose to you what information it collects, uses, discloses, and sells. Verification Procedure
To protect your privacy and maintain the security of your information, Termite Shield will take steps to verify your identity before processing any request. When you submit a request, we will verify your identity through one or more of the following methods:
- Authenticated Account Users: If you have a registered Termite Shield account, we will verify your request through your account login credentials.
- Non-Account Users: We will ask you to provide your full name, email address, phone number, and a brief description of your relationship with Termite Shield.
- Authorized Agents: We require written and signed authorization from the individual, along with your valid identification.
California's "Shine the Light" Law
A California resident with whom Termite Shield has an established relationship has the right to request information about Termite Shield's disclosure of personal information to affiliated companies or third parties for their direct marketing purposes. Children and Minors
Termite Shield makes no active effort to collect personal information from children under the age of 18 and does not wish to receive any such information.
Special Terms for Apple Users
Users of Termite Shield Apps acknowledge that they have reviewed and agree to the terms of the online app marketplace from which they have downloaded the App. The following additional terms and conditions apply with respect to any App that Termite Shield provides to you designed for use on an Apple iOS-powered mobile device:
- You acknowledge that these Terms are between you and Termite Shield only, and not with Apple, Inc. ("Apple").
- Your use of Termite Shield's iOS App must comply with Apple's then-current App Store Terms of Service.
- Termite Shield, and not Apple, is solely responsible for our iOS App and the services and Content available thereon.
- You agree that Termite Shield, and not Apple, is responsible for addressing any claims by you or any third party relating to our iOS App.
- You agree that Termite Shield, and not Apple, shall be responsible for the investigation, defense, settlement and discharge of any third party intellectual property infringement claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo.
- You agree to comply with all applicable third party terms of agreement when using our iOS App.
- Apple and Apple's subsidiaries are third party beneficiaries to these Terms as they relate to your license of our iOS App.
